1. General
These Terms of Service govern the use of the Fallout GroundZero website, digital services, media, creative content, information, promotional material and other content made available through Fallout GroundZero.
By accessing or using this website or its services, you acknowledge that you have read and understood these Terms of Service and agree to comply with them.
Fallout GroundZero reserves the right to update these Terms of Service when necessary to reflect changes in its services, applicable legislation, technology or business operations. The most recent version published on the website shall apply from the date stated above.
2. Fallout GroundZero and its content
Fallout GroundZero provides and publishes creative content, media, visual material, audio material, promotional content, digital material, information and other creative or informational works.
Unless otherwise stated, content published by Fallout GroundZero, including but not limited to recordings, artwork, photographs, graphics, logos, text, video, designs, digital media and other materials, is protected by applicable intellectual property laws.
No content may be copied, reproduced, distributed, modified, commercially exploited or otherwise reused without the appropriate rights, permission or legal basis.
3. Intellectual property and rights
All intellectual property rights relating to Fallout GroundZero materials remain with their respective rights holders.
Where content is created or published on behalf of an artist, creator, producer, collaborator, partner or other rights holder, ownership and licensing may be governed by separate agreements.
The publication of content on the Fallout GroundZero website does not automatically grant visitors or third parties a licence to reproduce, redistribute, modify, commercially exploit or claim ownership of that content.

5. AI-generated and AI-assisted content
Fallout GroundZero may use artificial intelligence and machine-learning technologies as part of creative, technical, editorial, production, design, development or administrative processes.
AI may be used as an assistive tool for brainstorming, editing, text processing, image processing, audio processing, production workflows, design development, metadata preparation, translation or other creative and technical purposes.
The use of AI does not by itself determine ownership or copyright status. Rights in a particular work depend on applicable law, the nature of the human contribution, rights relating to underlying material and any applicable contractual arrangements.
5.1 Transparency
Fallout GroundZero aims to maintain transparency regarding material that has been materially generated or manipulated using AI.
Where applicable under European Union or national law, Fallout GroundZero will provide an appropriate disclosure or label indicating that content has been artificially generated or manipulated.
This may include, depending on the nature and context of the material, visual labels, written disclosures, metadata, platform-specific disclosures or other technically appropriate methods.
5.2 AI-assisted content and website disclosure
Fallout GroundZero uses modern digital software, online services and website platforms that may incorporate artificial intelligence and machine-learning functionality.
This may include writing, grammar and spelling tools, image and audio software, editing tools, translation services, website-building systems and other digital applications.
Because AI functionality is now integrated into many commonly used software applications and online platforms, it is not always technically possible to determine whether an individual element of a website has been processed with or without AI assistance.
Fallout GroundZero therefore applies a simple and consistent transparency standard:
All content published on the Fallout GroundZero website is considered AI-assisted.
This is a general website-wide disclosure and is intended to avoid the need for individual AI notices, labels or statements to be placed underneath or alongside every text, image, recording, design or other piece of content.
The designation AI-assisted does not mean that every item of content was generated by artificial intelligence. It means that AI-enabled software or services may have been involved somewhere in the wider creation, editing, processing, preparation or publication workflow.
Human authorship, artistic direction, creative decisions, editorial decisions and other human contributions remain distinct from the software and technology used in the production process.
5.3 EU transparency and legal compliance
Fallout GroundZero complies with applicable European Union and national requirements concerning artificial intelligence and AI-generated or AI-manipulated content.
Where applicable law requires a specific disclosure or labelling method, Fallout GroundZero will provide the legally required disclosure.
The website-wide AI-assisted designation is an additional transparency measure adopted by Fallout GroundZero. It is not intended to suggest that EU law requires every individual item of content on this website to carry an AI label.
This approach allows Fallout GroundZero to maintain a clear and consistent disclosure without unnecessarily placing repetitive AI notices throughout the website.
5.4 Meaning of the AI-assisted designation
For the purposes of this website, AI-assisted means that artificial intelligence may have been involved somewhere within the broader digital production or publication environment.
It does not constitute a statement that:
* the entire work was generated by AI;
* the work has no human author;
* the work has no human creative or editorial contribution; or
* the content is necessarily subject to a mandatory AI label under applicable law.
The designation is used as a general transparency statement covering the Fallout GroundZero website as a whole.
Visitors therefore do not need to determine individually whether a particular sentence, photograph, graphic, recording or other website element was created with or without AI assistance.
5.5 Compliance with applicable EU requirements
Fallout GroundZero will comply with applicable European Union and national transparency requirements concerning artificial intelligence.
Article 50 of the EU Artificial Intelligence Act establishes transparency obligations for certain AI-generated and AI-manipulated content. Fallout GroundZero nevertheless chooses to apply a broader internal transparency standard to its website.
Accordingly, the use of an AI-assisted designation on the Fallout GroundZero website may exceed the minimum disclosure required by applicable law.
Where a specific legal disclosure or labelling requirement applies, Fallout GroundZero will provide the disclosure required by applicable law in an appropriate form.
Where no specific legal disclosure is required, Fallout GroundZero may nevertheless retain its broader AI-assisted website designation as a voluntary transparency measure.
Nothing in this section should be interpreted as claiming that European Union law requires every item of content on the Fallout GroundZero website to be labelled as AI-generated.
The distinction between legal AI labelling requirements and the voluntary transparency standard adopted by Fallout GroundZero is intentional.
6. User submissions
Where users, artists, creators or other contributors submit material to Fallout GroundZero, they remain responsible for the legality and rights status of the material they submit.
By submitting material, the submitting party confirms that they have the necessary rights or permissions to provide the material for the intended purpose.
The submitting party must not knowingly submit material that infringes the intellectual property, privacy, publicity or other legal rights of another person or organisation.
7. Removal of content
Fallout GroundZero may remove, restrict or temporarily disable access to content where there is a reasonable basis to believe that the content:

* violates applicable law;

* creates a significant legal or security risk; or

Where appropriate, Fallout GroundZero may request additional information before deciding whether content can remain available.
8. External platforms and services
Fallout GroundZero may use or link to third-party platforms and services, including music platforms, social-media platforms, hosting providers, payment providers, analytics services, AI services and other technical providers.
Those services may have their own terms, privacy policies, content policies and technical requirements.
Fallout GroundZero is not responsible for the independent operation, availability, policies or decisions of third-party platforms.
9. Website availability
Fallout GroundZero makes reasonable efforts to keep its website and services available and functioning correctly.
However, continuous availability cannot be guaranteed.
Temporary interruption may occur because of maintenance, technical problems, hosting issues, security measures, updates, third-party services or circumstances beyond the reasonable control of Fallout GroundZero.
10. Accuracy of information
Fallout GroundZero aims to provide accurate and up-to-date information.

Nothing in these Terms of Service is intended to constitute professional legal, financial, medical or other specialist advice.
14. Changes to these Terms
Fallout GroundZero may amend these Terms of Service when reasonably necessary.
Changes may be made to reflect:

* changes in technology;
* changes to Fallout GroundZero services;

AI-assisted software and the Fallout GroundZero transparency standard
Fallout GroundZero recognises that modern digital production and publication increasingly depend on software containing artificial intelligence and machine-learning functionality.
This includes, among other things, writing assistance, grammar and spelling correction, translation, image processing, audio processing, editing and other commonly used digital tools.
In practice, it is not always technically possible for a publisher to determine whether a particular function within commercially available software has relied upon artificial intelligence, particularly where AI functionality is integrated into an otherwise conventional editing or production tool.
Fallout GroundZero also recognises that a spelling or grammar check should not be confused with substantive human editorial review.
For that reason, Fallout GroundZero chooses to adopt a precautionary transparency standard.
Where there is reasonable uncertainty about whether AI has materially contributed to the creation, transformation or preparation of published content, Fallout GroundZero may disclose the use of AI assistance rather than making an unsupported claim that the content is entirely human-produced.
This approach is intentionally more transparent than relying solely on the minimum circumstances in which a public AI label is legally mandatory.
An AI or AI-assisted designation on Fallout GroundZero therefore does not necessarily mean that the entire work was generated by artificial intelligence.
It may simply indicate that AI-enabled software formed part of the production, editing, preparation or publication workflow.
Fallout GroundZero considers this approach appropriate in an environment where AI functionality is increasingly embedded in ordinary commercial software and where the technical distinction between conventional software assistance and AI-assisted functionality cannot always be independently verified by the publisher.
Where applicable law requires a specific disclosure, Fallout GroundZero will comply with that requirement.
Where the law does not require a label but the use of AI cannot reasonably be excluded or verified, Fallout GroundZero may nevertheless apply its own broader transparency standard.
